1. Definitions

For the purposes of these Terms:

“D&D” or “Dreams & Designs” refers to Dreams & Designs Fashion Studio, a fashion services provider based in Bangalore, Karnataka, India.

“Services” refers to all services offered by D&D including but not limited to bespoke clothing, embroidery services, fashion education, supplies store, and community activities.

“Website” refers to dreamsanddesigns.in and all associated subdomains and pages.

“User”, “You”, or “Client” refers to any individual or entity using our Services.

“Products” refers to physical items including bespoke garments, embroidered items, and supplies sold by D&D.

“Courses” refers to educational programs offered through D&D Fashion School.

“Content” refers to all text, images, videos, designs, patterns, and other materials available through our Services.

2. Our Services

Dreams & Designs operates through four main service pillars:

2.1 Service Availability

• Services are subject to availability and may vary based on capacity, materials, and seasonal demand
• We reserve the right to refuse service or limit quantities at our discretion
• Service offerings, pricing, and features may change without prior notice
• Express services are available for select items with additional charges

2.2 Geographic Limitations

• Physical services (bespoke clothing, embroidery) are primarily available in Bangalore, Karnataka
• Online courses are available globally
• Supplies shipping is currently limited to Bangalore and surrounding areas
• Special arrangements may be made for clients outside our service area on a case-by-case basis

3. User Accounts

3.1 Account Creation

• You must be at least 13 years old to create an account
• Users under 18 require parental or guardian consent
• You must provide accurate, complete, and current information
• You are responsible for maintaining the confidentiality of your account credentials
• One person or entity may maintain only one account

3.2 Account Security

• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach
• We are not liable for any loss or damage from unauthorized account use
• You must not share your account credentials with others

3.3 Account Termination

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Orders & Payments

4.1 Placing Orders

• All orders are subject to acceptance and availability
• We reserve the right to refuse or cancel any order for any reason
• Order confirmation does not guarantee fulfillment
• Prices are in Indian Rupees (INR) unless otherwise stated

4.2 Pricing

• Prices are subject to change without notice
• Quoted prices are valid for 30 days unless otherwise specified
• Custom/bespoke orders receive individual quotes based on requirements
• Additional charges may apply for express services, special materials, or complex designs
• Applicable taxes will be added to the final price

4.3 Payment Terms

• Bespoke Services: 50% advance payment required, balance due upon completion
• Embroidery Services: Payment terms vary by project size
• Fashion School: Full course fees due upon enrollment (payment plans available)
• Supplies Store: Full payment required at time of purchase
• Express Services: Full payment required upfront

4.4 Accepted Payment Methods

• Credit/Debit Cards (Visa, Mastercard, RuPay)
• UPI (Google Pay, PhonePe, Paytm, etc.)
• Net Banking
• Cash (in-store only)
• Bank Transfer (for bulk orders)

4.5 Payment Processing

Payments are processed through secure third-party payment gateways. We do not store complete credit card information on our servers. By providing payment information, you authorize us to charge the specified amount.

5. Bespoke Services Terms

5.1 Consultation & Design

• Initial consultations are complimentary for potential clients
• Design consultations are included in bespoke service pricing
• Detailed design specifications must be agreed upon before work commences
• Design changes after approval may incur additional charges

5.2 Measurements

• Accurate measurements are essential for proper fit
• Clients are responsible for providing correct measurements
• In-person measurements are recommended for best results
• We are not responsible for fit issues arising from incorrect client-provided measurements
• We offer one complimentary fitting adjustment per garment

5.3 Materials & Fabric

• Client-Provided Fabric: D&D is not responsible for quality or suitability of client-supplied materials
• D&D-Sourced Fabric: We source high-quality materials from reputable suppliers
• Fabric availability may affect timelines
• Natural variations in fabric (especially silk and handloom) are not considered defects
• Extra fabric (if any) remains property of the client

5.4 Timelines

• Regular Services: 2-4 weeks depending on complexity
• Express Services: 24-hour turnaround available for select items
• Bridal Packages: 4-8 weeks recommended
• Complex Projects: Timeline provided during consultation

5.5 Fittings & Adjustments

• One fitting session and adjustment included in bespoke pricing
• Additional fittings may be charged separately
• Clients must attend scheduled fittings on time
• Significant weight changes after final fitting may affect fit
• Major alterations beyond normal adjustments will incur additional charges

5.6 Wedding & Event Services

• Bridal consultations should begin 3-6 months before the event
• Complete bridal packages include pre-wedding, wedding, and post-wedding outfits
• Rush orders for events may incur premium charges (20-50% additional)
• Backup plans should be discussed for destination weddings

6. Fashion School Terms

6.1 Course Enrollment

• Full course fees must be paid before accessing course materials
• Payment plans are available for courses over ₹10,000
• Student ID cards are issued upon full payment
• Enrollment is subject to course availability
• Minimum age for enrollment is 13 years (with parental consent for minors)

6.2 Course Delivery

• In-Person Classes: Held at our Bangalore studio
• Online Live Classes: Conducted via video conferencing platforms
• Recorded Courses: Access provided through our learning platform
• Hybrid Courses: Combination of online and in-person sessions

6.3 Course Materials

• Digital course materials are provided for online courses
• Physical materials and supplies are not included unless specified
• Students receive 20% discount on all supplies from D&D store
• Pre-packaged course material kits available at special pricing

6.4 Attendance & Participation

• Minimum 80% attendance required for certification
• Missed classes may be made up based on availability
• Students must complete assignments and projects
• Active participation expected in live sessions

6.5 Certification

• Certificates issued upon successful course completion
• Requirements: 80% attendance + completed projects + passing assessment
• Certificate replacement fees: ₹500
• Digital certificates provided; physical certificates available on request

6.6 Course Changes & Cancellations

• D&D reserves the right to modify course content, schedule, or instructors
• Students will be notified of significant changes
• If D&D cancels a course, full refund will be provided
• Course transfers to future batches subject to availability and ₹1,000 fee

6.7 Code of Conduct

• Respectful behavior toward instructors and fellow students required
• Plagiarism and cheating are strictly prohibited
• Studio equipment must be used carefully and returned in good condition
• Photography/recording of classes requires permission
• Violation may result in dismissal without refund

7. Supplies Store Terms

7.1 Product Information

• We strive to display products accurately but cannot guarantee exact color representation
• Product descriptions are provided to the best of our knowledge
• Availability is subject to stock levels
• Specifications may vary slightly from displayed information

7.2 Pricing & Discounts

• Student Discount: 20% off for enrolled D&D students
• Bulk Orders: Tiered discounts available (contact for quote)
• Seasonal Sales: Periodic promotional offers
• Loyalty Program: Points earned on purchases

7.3 Online Orders

• Online orders available for Bangalore delivery
• Same-day pickup available for orders placed before 2 PM
• Home delivery within Bangalore: ₹100 flat rate
• Free delivery on orders over ₹2,000
• Order confirmation sent via email

7.4 In-Store Purchases

• Walk-in customers welcome during business hours
• Expert assistance available for material selection
• Custom fabric cutting available
• Cash and card payments accepted

7.5 DIY Kits

• All materials and instructions included as listed
• Online tutorial access provided
• Kits are non-returnable once opened
• Replacement of defective materials provided

7.6 Custom Orders

• Minimum order quantities may apply for custom items
• Custom orders are non-refundable
• Lead time: 2-4 weeks depending on item
• 50% advance payment required

8. Intellectual Property

8.1 D&D’s Intellectual Property

• All content on our website, including designs, patterns, course materials, and logos, is owned by D&D
• Protected by copyright, trademark, and other intellectual property laws
• Use without permission is strictly prohibited
• Course materials are licensed for personal use only

8.2 Client Designs

• You retain ownership of your original design concepts
• D&D may showcase completed projects in portfolio with your permission
• Permission is requested before using photos/designs in marketing
• You may revoke showcase permission at any time

8.3 Course Work & Student Projects

• Students retain rights to their created designs and projects
• D&D may showcase student work with permission
• Course materials remain property of D&D
• Students may not redistribute course materials

8.4 Trademarks

“Dreams & Designs”, “D&D Fashion Studio”, and our logo are trademarks of Dreams & Designs. Use without permission is prohibited.

9. User-Generated Content

9.1 Reviews & Testimonials

• Honest reviews are welcome and encouraged
• Reviews must be based on genuine experience
• Offensive, defamatory, or inappropriate content will be removed
• We reserve the right to use reviews in marketing materials

9.2 Community Content

• Bangalore Sewing Club members may share projects and tips
• Content must be respectful and relevant
• We reserve the right to moderate or remove content
• Copyright infringement is not tolerated

9.3 Photo & Video Submissions

By submitting photos/videos of your projects:

• You grant D&D permission to use them in marketing materials
• You confirm you own rights to the content
• You will be credited unless you request anonymity
• You may request removal at any time

10. Refunds & Cancellations

10.1 Bespoke Services

• Before Work Begins: Full refund minus ₹1,000 consultation fee
• After Fabric Cut: No refund (fabric costs already incurred)
• During Construction: Refund of balance minus completed work value
• After Completion: No refund unless quality issue
• Timeline: Cancel at least 7 days before scheduled completion

10.2 Fashion School Courses

• Before Course Starts: Full refund minus ₹500 processing fee
• Within First Week: 80% refund
• After First Week: No refund
• Course Transfer: ₹1,000 fee, subject to availability
• Notice: 7 days advance notice required

10.3 Supplies Store

• Unused Items: Return within 7 days with receipt
• Defective Items: Exchange or refund within 30 days
• Custom-Cut Fabric: Non-returnable
• Opened Supplies: Non-returnable (hygiene reasons)
• DIY Kits: Returnable if unopened within 7 days

10.4 Refund Processing

• Refunds processed within 7-10 business days
• Refunded to original payment method
• Shipping charges are non-refundable
• Return shipping costs borne by customer unless item defective

11. Warranties & Disclaimers

11.1 Service Quality

We warrant that:

• Services will be performed with professional skill and care
• Materials used will be of good quality
• Work will match agreed specifications
• Timelines will be honored to the best of our ability

11.2 Limitations

We do NOT warrant:

• Perfect fit if measurements provided by client are inaccurate
• Suitability of client-provided fabrics
• Results from client-provided patterns or designs
• Natural variations in handmade/handloom materials

11.3 Website Disclaimer

• Website content provided “as is” without warranties
• We do not guarantee uninterrupted or error-free website operation
• Product images are representative; actual items may vary slightly
• We are not responsible for typographical errors in pricing

11.4 Educational Content

• Course content is for educational purposes
• Results depend on individual skill and practice
• We do not guarantee employment or business success
• Techniques should be practiced safely

12. Limitation of Liability

12.1 Maximum Liability

Our total liability for any claim related to our services shall not exceed the amount paid by you for the specific service or product giving rise to the claim.

12.2 Excluded Damages

We are not liable for:

• Indirect, incidental, or consequential damages
• Lost profits or business opportunities
• Emotional distress or psychological harm
• Third-party claims
• Damages beyond our reasonable control

12.3 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our control, including:

• Natural disasters (floods, earthquakes, pandemics)
• Government actions or restrictions
• Supply chain disruptions
• Power failures or technical issues
• Labor disputes or strikes

12.4 Client Responsibility

You are responsible for:

• Providing accurate information and measurements
• Attending scheduled fittings and consultations
• Proper care of completed garments
• Timely payments
• Following course safety guidelines

13. Prohibited Activities

You agree NOT to:

13.1 Illegal Activities

• Use our services for any illegal purpose
• Violate any local, state, national, or international law
• Engage in fraudulent activities

13.2 Intellectual Property Violations

• Copy, reproduce, or distribute our course materials
• Share login credentials with others
• Record or screenshot classes without permission
• Use our designs, patterns, or content without authorization

13.3 Harmful Conduct

• Harass, abuse, or harm others
• Post offensive or inappropriate content
• Spread false or misleading information
• Impersonate others

13.4 System Abuse

• Attempt to hack or compromise our systems
• Upload viruses or malicious code
• Interfere with website operation
• Use automated systems to access our services

14. Termination

14.1 By You

You may terminate your relationship with D&D at any time by:

• Closing your account
• Ceasing to use our services
• Following cancellation procedures outlined in Section 10

14.2 By D&D

We may suspend or terminate your access if:

• You violate these Terms
• You engage in fraudulent activity
• Your account is inactive for extended periods
• We discontinue services
• Required by law

14.3 Effect of Termination

• Outstanding payments remain due
• Completed work remains your property
• Course access is revoked (except completed courses)
• Certain provisions survive termination (intellectual property, liability limitations)

15. Dispute Resolution

15.1 Informal Resolution

If you have a concern or dispute, please contact us first. We commit to good-faith efforts to resolve issues amicably.

15.2 Mediation

If informal resolution fails, disputes may be submitted to mediation before pursuing legal action.

15.3 Jurisdiction

• These Terms are governed by the laws of India
• Specifically, laws of Karnataka state
• Bangalore courts have exclusive jurisdiction

15.4 Arbitration

For disputes over ₹50,000:

• Parties agree to binding arbitration
• Conducted in Bangalore
• Under Indian Arbitration and Conciliation Act, 1996
• Single arbitrator mutually agreed upon

15.5 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or consolidated proceeding.

16. General Provisions

16.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and D&D.

16.2 Modifications

• We may update these Terms at any time
• Material changes will be communicated via email
• Continued use after changes constitutes acceptance
• You should review Terms periodically

16.3 Severability

If any provision is found unenforceable, the remaining provisions continue in full force.

16.4 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

16.5 Assignment

• You may not assign or transfer these Terms
• D&D may assign these Terms in case of merger, acquisition, or sale

16.6 Communication

• Electronic communications are binding
• Official notices sent to registered email address
• You must keep contact information current

16.7 Language

These Terms are provided in English. In case of translation, the English version prevails.

16.8 Third-Party Rights

These Terms do not create rights for third parties.
